Welcome to FitResolv. By downloading, accessing, or using our app, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By using FitResolv, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the app.

2. Description of Service

FitResolv is a fitness application that provides:

  • Smart workout generation
  • Exercise library and workout logging
  • Recovery tracking and analysis
  • Personal records and progress tracking
  • Apple Health integration
  • Apple Watch heart rate monitoring during workouts

3. Eligibility

You must be at least 17 years old to use FitResolv. By using the app, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Health and Fitness Disclaimer

IMPORTANT: FitResolv is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition.

  • The workouts, recovery recommendations, and health-related information provided by FitResolv are for general informational purposes only.
  • Always consult with a qualified healthcare professional or certified personal trainer before beginning any exercise program.
  • If you experience any pain, discomfort, or unusual symptoms during exercise, stop immediately and seek medical attention.
  • The recovery tracking and plateau detection features are based on algorithms and should not replace professional medical advice.
  • Heart rate data and calorie calculations are estimates and may not be accurate for all individuals.

You assume full responsibility for any risks associated with using the app and engaging in physical exercise.

5. Account and Subscriptions

5.1 No Account Required

FitResolv does not require you to create an account. Your data is stored locally on your device and synced through your personal iCloud account.

5.2 Subscription Terms

FitResolv offers subscription-based premium features:

  • Free Trial: New users may receive a 7-day free trial of premium features.
  • Subscription Options: Monthly and annual subscription plans are available.
  • Payment: Subscriptions are billed through Apple's App Store and charged to your Apple ID.
  • Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
  • Cancellation: You may cancel your subscription at any time through your Apple ID account settings.
  • Refunds: Refund requests are handled by Apple according to their refund policies.

5.3 Price Changes

We reserve the right to change subscription prices. Any price changes will not affect current subscribers until their next renewal period.

6. User Conduct

You agree not to:

  • Use the app for any illegal purpose or in violation of any laws
  • Attempt to reverse engineer, decompile, or disassemble the app
  • Circumvent any security measures or access restrictions
  • Use the app to transmit malware or other harmful code
  • Interfere with or disrupt the app's functionality
  • Use automated systems or scripts to access the app

7. Intellectual Property

7.1 Our Content

FitResolv and all its content, features, functionality, design, graphics, and software are owned by FitResolv and are protected by copyright, trademark, and other intellectual property laws.

7.2 Your Content

You retain ownership of any data you create within the app (workout logs, notes, etc.). By using the app, you grant us a limited license to process this data solely to provide the app's functionality.

7.3 Exercise Library

The exercise descriptions and instructions in our library are for personal use within the app only and may not be reproduced, distributed, or used commercially without permission.

8. Third-Party Services

8.1 Apple Services

FitResolv integrates with Apple services including:

  • Apple Health (HealthKit): For reading health data and writing workout data
  • iCloud (CloudKit): For syncing your data across devices
  • Apple Watch: For heart rate monitoring during workouts
  • App Store: For subscription management and payments

Your use of these services is governed by Apple's terms and conditions.

8.2 Third-Party Liability

We are not responsible for any third-party services, their availability, or their handling of your data.

9. Disclaimers and Limitations of Liability

9.1 "As Is" Service

FitResolv is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9.2 No Guarantees

We do not guarantee that:

  • The app will meet your specific requirements or fitness goals
  • The app will be uninterrupted, timely, secure, or error-free
  • The results from using the app will be accurate or reliable
  • Any workout recommendations will be suitable for your individual circumstances

9.3 Limitation of Liability

To the maximum extent permitted by law, FitResolv and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Personal injury or health issues arising from exercise
  • Loss of data or workout history
  • Inaccurate health metrics or calculations
  • Interruption of service or app functionality

Our total liability shall not exceed the amount you paid for the app in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless FitResolv and its developers from any claims, damages, losses, or expenses arising from your use of the app or violation of these Terms.

11. Changes to the App and Terms

11.1 App Updates

We may update, modify, or discontinue any feature of the app at any time. We will endeavor to provide notice of significant changes.

11.2 Terms Updates

We may revise these Terms from time to time. The updated version will be indicated by an updated "Last updated" date. Continued use of the app after changes constitutes acceptance of the new Terms.

12. Termination

You may stop using FitResolv at any time by deleting the app. We may terminate or suspend your access to the app if you violate these Terms or engage in any conduct we deem harmful to the app or other users.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the app shall be resolved through binding arbitration, except where prohibited by law. You agree to waive any right to participate in class action lawsuits.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FitResolv regarding your use of the app.
